How ADUs Could Help Californians Break Into Homeownership
San José has achieved a significant milestone in California's housing development landscape by approving the state's first conversion of an accessory dwelling unit into a condominium under Assembly Bill 1033.
The 2024 law allows homeowners to sell ADUs as separate condominiums, creating new pathways to homeownership and property investment opportunities.
Developer AlphaX RE Capital received official certification for their Josefa Street property near downtown San José during a public ceremony Thursday, with Mayor Matt Mahan calling it "history in the making." The law represents a substantial shift for California property developers and homeowners seeking to maximize their investment potential.
Previously, ADUs could only be rented out while remaining tied to the main property's ownership.
Now, these units can be subdivided and sold independently as condominiums, potentially making homeownership more accessible to buyers priced out of traditional single-family home markets.
Developer Bob Hughes is expected to become the second in the state to complete an ADU-to-condo conversion within weeks at his Lantz Avenue property in San José.
The development trend could provide California homeowners with new revenue streams while addressing the state's housing shortage by creating more affordable ownership opportunities, particularly as ADUs are inherently more affordable by design than traditional homes.
