San Jose becomes first California city to allow sale of ADUs as condos

· sfchronicle.com ↗ · San

San Jose has become the first city in California to authorize the sale of accessory dwelling units as individual condominiums, marking a significant policy shift that could provide new pathways to homeownership and additional revenue streams for property owners.

The groundbreaking ordinance allows homeowners who have constructed ADUs on their properties to legally separate and sell these units as condos, rather than being required to sell them only as part of the main property.

This development represents a major expansion of California's ADU program, which has already allowed property owners to build secondary housing units such as converted garages, basement apartments, or standalone structures on single-family lots.

While ADUs have previously served primarily as rental units or housing for family members, San Jose's new policy transforms them into potential ownership opportunities for buyers seeking more affordable entry points into the housing market.

The change could prove particularly significant for property developers and homeowners looking to maximize returns on ADU investments, as condo sales typically generate higher profits than long-term rentals.

Other California municipalities are expected to closely monitor San Jose's implementation of this policy, as the approach could serve as a model for addressing the state's ongoing housing affordability crisis while creating new opportunities in the real estate development sector.
